The Staff, Medical Directors and Expert Witnesses have combined experience in consulting and assisting 20,000 Attorneys in recovering hundreds of millions of dollars in over 85,000 Medical Malpractice cases. Medical Review Foundation, Inc. can substantially increase your opportunity for success as well as the value of your cases by providing our professional services and qualified Medical Experts to help you effectively prove all issues of Negligence, Causation and Damages.

We have more than 7,500 independent Board Certified Medical Experts, Nationwide, in all specialties, available to review your case. These Experts, many of whom are professors and/or in private practice, are located in every state, and are concerned Medical Professionals who will testify in support of their unbiased opinions.

At your Clients option, our firm is retained on either a Fee For Service basis or under an optional 15% Contingency Contract (drafted in conformity with State Bar Codes of Professional Responsibility and Rules of Conduct), which does not “fee split” with you nor pay or involve the independent contractor Experts on any Contingency fee basis.*

Case Evaluation Report: 
This report, prepared by one of our Medical Directors and Staff, includes a written analysis of the issues involving Negligence, Causation, Damages, and potential defendants. Available in approximately six weeks. Expedited service is also available.

Expert Review and Report:  
This report is prepared by qualified, Board Certified Physicians who are available to testify in support of their opinions.

Explanation of Services:

Option A: Fee For Service Program

In-House Services:

1. Case Evaluation Report: $750
Optional under the Fee For Service Program

Up to 100 pages reviewed: $750
Pages in excess of 100: $1.50 each
(Expedited Service: additional $550/Report)

Our Case Evaluation Report is especially helpful when the medical issues of your case are diverse or complex, or if there is more than one potential defendant. This report, prepared by one of our Medical Directors is comprehensive, detailed and not discoverable. Our Medical Directors do not serve as an Expert Witness and do not testify (See "Expert Witness Services."). Our Case Evaluations are unsigned, confidential, attorney work product privileged reports. This report is available in approximately six weeks. Expedited service is also available.

This optional report covers the multiple fields of expertise involved in your case, and discusses the medical issues, the appropriate standards of care, what deviations occurred, if any, and who should and should not be named as a defendant, and why. Additionally, the proximate cause of the damages, what future damages may result, theories of negligence and the strengths and weaknesses of your case are included, as appropriate. The potential defenses to your cause of action are also addressed.

Send the relevant medical records, statement of facts, and copies of x-rays (if appropriate). Our report is based upon, and limited by, the information contained in the materials sent to us for review.

Subsequent records submitted, including resubmission of illegible records, are reviewed at the rate of $150 per hour. Records submitted out of proper order for review will be organized at the rate of $150 per hour, with attorney approval.


2. Additional Work Requested
$400/hour

All additional in-house review and/or work requested is to be prepaid at the rate of $400 per hour, based upon our estimate of time involved. This includes all written correspondence for addendum and additional reviews with our Medical Directors and review of records, x-rays, depositions, articles, etc., which are submitted subsequent to our initial review and/or report.


3. Expedited Service
$550/Report

When you require a Case Evaluation Report in less than approximately six weeks, or by a date certain.


4. Administrative Costs for Excessive Records: $75

Prior to this date we have absorbed administrative costs, but do to rising expenses, we must now pass this cost on to our Clients. Processing your case in our office is included in the price of your initial requested Case Evaluation and/or Expert Witness Reports. Only when requests become excessive beyond our standard procedures, we charge an additional fee to cover our time. We will notify you in advance of the fee for this extraordinary service to offset our cost, when applicable.

Expert Witness Services:

1. Expert Witness Report
Up to 100 pages reviewed: $1100
Pages in excess of 100: $1.50 each
(Expedited Service: additional $550/Report)

We have more than 7,500 Board Certified Medical Experts on our independent Consulting Staff to review medical records, prepare written reports and testify in support of their opinions, through deposition and trial appearance, if given reasonable notice. (Oral opinions are available upon request.) This report is available in approximately six weeks. Expedited service is also available.

Many of these Expert Witnesses are professors and/or in private practice in their own communities. We will accommodate your requirements regarding geographic location, specialty and qualifications, where possible.

Send the relevant medical records, statement of facts, copies of x-rays (if appropriate). This report is based upon, and limited by, the information contained in the materials sent for review.

Our Staff reviews the Expert Witness Reports, prior to sending them to you. If we are not satisfied that the report is unbiased and responsive, whether or not it supports your case, we will replace the report with one from a second Board Certified Expert in the same medical specialty, free of charge.

The Expert Witness Report will initially be sent to you with information identifying the Expert Witness removed. After you review this report, if for any reason you are dissatisfied, the report of a second Expert Witness in the same specialty will be obtained for payment of one-half the original fee. This replacement service must be requested within thirty days from your receipt of the original report.


2. Additional Review/Research Requested of Medical Expert
$400/hour

We recommend that you send our office all of the medical records and/or x-rays at the same time. In the end, it will make it easier for the Medical Director and/ or Expert to provide us just one report. The Medical Director and/ or Expert will then not have to do an Addendum Report and request additional money for his/her supplementary review. For this Medical Director and/ or Expert to re-review the initial records in order to familiarize them self with the case and then to review the new information after the first report is transcribed, takes more time away from his/her practice and obligations. In the end it will save you and your Client money and time.


3. Expedited Service
$550/Report

To be paid when you require an Expert Witness Report in less than approximately six weeks, or by a date certain. The Experts need to put your review as priority before their patients.


4. To Retain The Expert Witness After You Have Received A Supportive Written Opinion:
Our Expert Referral Fee, which includes release of their name is:

$1200-$2300 (depending on Specialty)

Plaintiff and Plaintiff's attorney sign our Contract For Expert Witness Retained Directly By Attorney, agreeing to negotiate directly with the Expert Witness for all future services, including testimony. Additionally, Plaintiff and Plaintiff's attorney agree to be financially responsible for payment to the Expert Witness for any and all additional services requested by Plaintiff's attorney. It is understood and agreed that no liability will accrue to the Medical Review Foundation Inc. at this point with this Expert Witness. Upon receipt of your Firm's check for our Expert Referral Fee and the properly executed Contract, you will receive the Expert's original, signed report and Curriculum Vitae.

 

Option B: 15% Contingency Fee Contract Program

Available in any case, at Plaintiff's option.
Medical Review Foundation, Inc. receives 15% of the total recovery.

This Contract, which is ethical and Bar approved, has been designed in accordance with State Bar Codes of Professional Responsibility and Rules of Professional Conduct. This Contract does not involve the independent contractor Expert Witnesses, who are prepaid in full and who are not contingent upon the outcome of the case, directly or indirectly. Our Medical Directors, employees and shareholders do not testify. [Rule 3.4(b) and DR7-109(c)].

As the Plaintiff's attorney, you are not a party to this Contract between the Plaintiff and Medical Review Foundation, Inc. At all times you control the course, conduct and settlement of Plaintiff's case, and do not fee split or share fees with Medical Review Foundation, Inc. As both you and our firm receive a contingency fee from the total gross recovery, neither fee diminishes the other. [Rule 5.4(a) and DR3-103(A)].

Under this Contract, Medical Review Foundation, Inc. staff is available - on an unlimited basis - for review, research, discussion and analysis of the medical issues involved in your case. We serve as your non-legal Consultant, at your request, and do not practice law. [Rule 5.5(b) and DR3-101(A)]. If there are local or state medical standards of care, as opposed to a national standard of care, in qualifying Experts Witnesses for your case, it is attorney’s responsibility to properly inform in writing the Medical Review Foundation, Inc. of that local and state standard of care to the satisfaction of Plaintiff’s attorney. It is not the responsibility of the Medical Review Foundation, Inc. at any time to know or educate the Expert Witness in this matter. 

In addition, we provide the Plaintiff and the Plaintiff's attorney with independent, Board Certified Medical Expert Witnesses to prepare reports and to testify to their opinions if supportive of negligence, causation and damages.

No costs, liens, fees or expenses are deducted from our 15% contingency fee of the total recovery.

Prior Court approval for the use of this Contract is required in cases involving a minor, incapacitated adult or estate in most states.

In cases where Medical Review Foundation, Inc. has been retained on a fee-for-service basis, Plaintiff may enter into this 15% Contingency Fee Contract, at any time, with prior written approval of Medical Review Foundation, Inc. There will be no refund or additional credit made for prior services rendered in those cases.

Summary of the 15% Contingency Contract

Our Case Evaluation Report, prepared by one of our Medical Directors is comprehensive, detailed, attorney work product privileged and is not intended for discovery. Our Medical Directors do not serve as an Expert Witness and do not testify (see "Expert Witness Report" below). Our Case Evaluations Reports are unsigned and confidential. This report is available in approximately six weeks. Expedited service is also available.

This report is prepared by Medical Review Foundation, Inc. prior to submission of medical records to an Expert Witness for review and report. Since we have a contingent interest in this case, we want to be in the best position to advise you and assist your client. Medical Review Foundation, Inc. reserves the right to substitute this written report with an Expert Witness Report at no additional charge.

Our report covers the multiple fields of expertise involved in your case, and discusses the medical issues, the appropriate standards of care, what deviations occurred, if any, and who should and should not be named as a Defendant, and why. Additionally, the proximate cause of the damages, what future damages may result, theories of negligence and the strengths and weaknesses of your case are included, as appropriate. The potential defenses to your cause of action are also addressed.

Send the properly executed 15% Contingency Contract signed by all plaintiffs and all attorneys, notarized, your Firm's check for $450 plus any surcharge for the records in excess of 100 pages (at 75¢ per page), the relevant medical records, statement of facts, and copies of x-rays (if appropriate) all depositions, petitions, complaints and all formal documents. This report is based upon, and limited by, the information contained in the materials sent to us for review.

2. Additional Work Requested of Medical Review Foundation, Inc. Staff: $100/hour

Our Medical Directors are available to discuss in writing the medical issues, research relevant topics, review depositions, help you to prepare interrogatories from a medical standpoint and generally to serve as an unlimited medical resource at $250 per hour with a one-hour minimum. All additional questions regarding your case must be submitted to our office in writing. All fees must be prepaid.

3. Expert Witness Report: $600
Available after the Case Evaluation report with the 15% Contingency Fee Contract
Maximum 100 pages reviewed: $600/Report
Pages in excess of 100: 75¢ each
(Expedited Service: additional $350/Report)

Many of the 7,500 Board Certified Medical Experts on our independent Consulting Staff are professors and/or in private practice in their own communities. We will accommodate your requirements regarding geographic location, specialty and qualifications, where possible.

These independent Expert Witnesses are presently available to testify in support of their opinions, through deposition and trial appearance, if given reasonable notice.

Plaintiff/Plaintiff’s Attorney may request an unlimited number of Expert Witness Reports, in any specialty, to document negligence, causation and damages. (Oral opinions are available upon request.) This report is available in approximately six weeks. Expedited service is also available. The fee noted above is for each Expert Witness Report.

Our Staff will review each Expert Witness Report, prior to sending it to you. If we are not satisfied that the report is unbiased and responsive, whether or not it supports your case, we will replace the report with one from another Board Certified Medical Expert of the same medical specialty, free of charge.


4. Additional Work Requested of Expert Witness: $250/hour

This includes telephone conferences, review of supplemental records, x-rays, articles, depositions, etc. at $250 per hour with a one-hour minimum. In-person conferences and physical examinations require a two-hour minimum. All fees must be prepaid.

6. Deposition and Court Tesimony

You and the Expert Witness arrange for their appearance and payment for their services. They require prepayment for their time and travel expenses. We waive our usual Release of Name Fee (profit) and rely on 15% of any recovery. At your request we will assist you in your fee negotiations with each Expert Witness we supply. Per the Contract our office coordinates all depositions and trial appearances with our Expert Witnesses.
